Background on Settlement

By now you should be aware of the class action settlement between Townsend N. Takushi and Joanne E. Brykczynski Living Trust, et al. vs. D.R. Horton, Inc., et al. regarding hurricane straps and, where installed, metal sill tracks used during the construction of qualifying D.R. Horton homes in Hawaii. This settlement includes structural strap, concrete, and, for homes with metal framing at the foundation level, sill track reinforcement repairs for certain homes constructed by D.R. Horton that are covered under the class.

The Court appointed SageWater to serve as the contractor to make the Court-approved repairs of 541 qualifying homes across the islands of Oahu, Maui, and Hawaii at no cost to those affected owners. If you own a D.R. Horton constructed home that qualifies for the Repair Program, you are automatically entitled to the repairs under this settlement.

This class action settlement resulted from alleged defects in the hurricane straps and metal sill tracks installed during construction of your home. The class action claimed that the straps and metal sill tracks installed in certain D.R. Horton homes in Hawaii may not be effective in the event of a significant wind event or hurricane. Members of the settlement class are entitled to, among other benefits, have SageWater install a new anchor bolt system, perform concrete repair work, and for qualifying homes with metal sill tracks, metal sill track repairs at no cost to the qualifying homeowners.

Hurricane straps and, where installed, metal sill tracks are metal components intended to secure homes to their concrete foundations. The class action claimed that the straps and, where installed, metal sill tracks used in the construction of the qualifying D.R. Horton homes were and are rusting, which may weaken their ability to perform as intended, and can also lead to concrete spalling or cracking, further reducing their effectiveness to protect your home in the event of a significant wind event or hurricane. The class action claimed that installing new anchor bolts, repairing metal sill tracks, and repairing concrete damaged by the hurricane straps and metal sill tracks will improve the structural integrity and safety of qualifying homes.

The process for installing new anchor bolts

The Court selected SageWater as the single vendor to complete the repairs under the Class Action Settlement. We will be handling the entire process, from scheduling and notifying homeowners and residents about when the work will be completed, to performing the repairs, and ensuring proper permits, inspections, and homeowner approvals are all completed in a timely manner.

Claiming your benefits

Qualifying homeowners with hurricane straps and, where installed, metal sill tracks are entitled to these repairs at no cost. There’s nothing required for qualifying homeowners to claim their benefits. All they have to do is simply register to begin their repair process.
